Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of IgnisGen (the "Service"), operated by NOCTURNA NETWORK LTD, a company registered in England and Wales (Company Number 16846806, VAT 506869363), with registered office at 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom.

By creating an account or using the Service, you agree to be bound by these Terms.

2. The Service

IgnisGen is an AI-powered Shopify theme generation platform. Users can generate downloadable Shopify OS 2.0 themes based on prompts, categories, and styles.

3. Accounts

  • You must provide accurate registration information.
  • You are responsible for maintaining account confidentiality.
  • One account per user; no sharing of credentials.
  • You must be 18 or older to use the Service.

4. Credits and Payment

  • IgnisGen operates on a pay-per-theme credit model.
  • Credits are purchased through Stripe in one-time payments. There are no recurring subscriptions.
  • Credits never expire but are non-refundable and non-transferable.
  • Free tier: 1 lifetime basic theme generation with "Generated with IgnisGen" branding.
  • Premium generations consume 1 credit each and include full features.
  • Prices are in USD unless otherwise stated. VAT may apply for EU/UK customers.

5. Refunds

No automatic refunds. Chargebacks will be handled manually and may result in account suspension. If you experience a technical issue that prevents theme delivery, contact ignisgen@ignisgen.com for case-by-case review.

6. License and IP

  • The Shopify themes you generate are licensed to you for use on Shopify stores you own or operate.
  • The underlying Dawn base is MIT-licensed by Shopify.
  • IgnisGen retains ownership of the platform, its AI models, and generation pipeline.
  • You retain ownership of your custom content (logos, brand briefs, uploaded images).

7. Acceptable Use

You agree NOT to:

  • Generate themes containing illegal, harmful, or offensive content
  • Use the Service for weapons, gambling, or adult content
  • Attempt to reverse-engineer or scrape the Service
  • Abuse rate limits or share account access

8. Limitations of Liability

The Service is provided "as is". NOCTURNA NETWORK LTD is not liable for indirect damages, loss of profits, or damages exceeding the amount you paid in the preceding 12 months.

Generated themes are validated with Shopify Theme Check but we do not guarantee compatibility with all Shopify configurations or third-party apps.

9. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account at any time by contacting ignisgen@ignisgen.com.

10. Governing Law

These Terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of London, UK.

11. Changes

We may update these Terms. Material changes will be communicated via email. Continued use after changes constitutes acceptance.
